Terms of service

Welcome to Arden Main. Throughout this document, the words "we", "our", and "us" all refer to Arden Main, a storefront operated by Ten Thirteen LLC. We run this website and everything connected to it — the catalog, checkout, features, tools, product listings, and any related content — to give you an organized way to shop the goods we offer (collectively, the "Services"). Our store runs on the Shopify platform, which is what makes the Services available to you.

This document, referred to below as the "Terms", sets out both what you can expect from us and what we expect from you when you use the Services. Read it in full before continuing, since it covers material points like our warranty disclaimers and the ceiling on our legal liability.

Any time you browse, interact with, or place an order through our Services, you are agreeing to abide by these Terms and by our Privacy Policy. If you are not comfortable with either document, please do not continue using the site.

Section 1 — Access and Account

By agreeing to these Terms, you represent that you have reached the age of legal majority wherever you live. Accounts are personal to you and cannot be sold, transferred, or reassigned to anyone else. Keeping your login credentials confidential and secure sits entirely on your shoulders, and you take responsibility for anything that happens under your account, whether or not you personally authorized it.

Section 2 — Our Products

We take considerable care to describe and photograph our products accurately, but small variations between what appears on screen and what arrives at your door are always possible. Color rendering in particular can shift depending on the monitor, phone, or display settings you're using, so we can't promise a pixel-perfect match. Product descriptions can be updated whenever necessary, and we reserve the right to cap available quantities, retire an item from the catalog, or make other product decisions at our discretion.

Section 3 — Orders

When you submit an order, what you are technically doing is proposing a purchase. Arden Main can accept or turn down any order for reasons of our own. An order isn't binding on us until we've both confirmed acceptance and successfully collected payment. Please look over your cart, shipping address, and payment method carefully before finalizing checkout, small mistakes at that stage can be expensive to reverse afterward. Any subsequent returns or exchanges will be handled under the terms laid out in our Refund Policy.

Section 4 — Prices and Billing

Prices posted on the site can change at any time and without a formal notice. The amount you're actually charged is the price shown to you at the moment your order is confirmed by our system and reflected in your order confirmation email. Unless we've said otherwise, listed prices do not include sales tax, shipping charges, or any duties that may apply. You agree to provide payment details that are accurate and current, and to update them promptly if anything changes on your end.

Section 5 — Shipping and Delivery

Any delivery estimates we publish are just that, estimates, and should not be read as guarantees. We can't take responsibility for lags caused by shipping carriers, customs inspection, severe weather, or anything else beyond our reasonable control. Once a parcel has been handed off to the carrier, the risk of loss or damage transfers from us to you.

Section 6 — Intellectual Property

Everything you encounter on the Services, the branding, wordmarks, written copy, product photography, video, sound, layout, and the way it's all put together, belongs to Arden Main or to the third parties who license their material to us, and all of it is protected under U.S. and international intellectual property law. Copying, redistributing, altering, or transmitting any of it without our written go-ahead in advance is not permitted, and we are keeping every right we have not explicitly given you.

Section 7 — Optional Tools

From time to time we may make additional third-party tools available through the Services. Anything of that kind is offered strictly on an "as is" and "as available" footing, with no warranties or endorsements attached from our side. Whatever happens as a result of your use of those tools is between you and the party who provides them.

Section 8 — Third-Party Links

Our Services will occasionally point out to websites we don't operate. We can't verify the accuracy, safety, or business practices of those sites, and we do not endorse them by linking to them. If you decide to follow one of those links, you're doing so at your own risk.

Section 9 — Relationship with Shopify

Arden Main runs on Shopify's e-commerce infrastructure, but the sales contract for every purchase you make is directly between you and Arden Main, not with Shopify. Shopify has no role in the transactions between us, and by using the Services you release Shopify and its affiliated companies from any claim connected to your purchase.

Section 10 — Privacy Policy

Personal information we collect while you're using the Services is handled in the way described in our Privacy Policy. By using the site, you're confirming that you've read that document and understood how your data is treated.

Section 11 — Feedback

If you share ideas, product reviews, comments, testimonials, or any other input with us, you are granting Arden Main a perpetual, worldwide, royalty free license to use, reproduce, edit, publish, translate, and distribute what you sent for any purpose we see fit. You also confirm that the material you submit is yours to share and does not violate anyone else's rights.

Section 12 — Errors and Omissions

Now and then a typo, mispriced item, out of date description, or missing detail may slip onto the site. If that happens, we reserve the right to correct the mistake and, where necessary, to cancel or modify any order placed on the basis of inaccurate information, even after checkout has been completed.

Section 13 — Prohibited Uses

The Services are available for lawful purposes only. You agree not to use them to break any law; to infringe someone else's copyright, trademark, or other intellectual property; to harass, threaten, defame, or otherwise harm any person; to distribute viruses or malicious code; to scrape or harvest personal data without permission; or to interfere with the operation of the site or the experience of other users. We may terminate access for any user who steps outside these limits.

Section 14 — Termination

We may end your access to the Services at any point, with or without prior notice, at our sole discretion. When access ends, any amounts you already owe remain payable in full. The sections of these Terms that address intellectual property, indemnification, warranty disclaimers, and limits on liability continue to apply after termination.

Section 15 — Disclaimer of Warranties

THE SERVICES AND THE PRODUCTS SOLD THROUGH THEM ARE MADE AVAILABLE ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT REPRESENTATIONS OR WARRANTIES OF ANY KIND, WHETHER EXPRESSED, IMPLIED, OR STATUTORY. THAT INCLUDES, WITHOUT LIMITATION, ANY IMPLIED WARRANTY OF MERCHANTABILITY, OF FITNESS FOR A PARTICULAR USE OR PURPOSE, OR OF NON-INFRINGEMENT. CERTAIN STATES OR JURISDICTIONS DO NOT ALLOW SUCH DISCLAIMERS OF IMPLIED WARRANTIES, IN WHICH CASE THE PORTIONS ABOVE THAT ARE NOT PERMITTED SIMPLY DO NOT APPLY TO YOU.

Section 16 — Limitation of Liability

TO THE MAXIMUM DEGREE ALLOWED UNDER APPLICABLE LAW, ARDEN MAIN AND TEN THIRTEEN LLC, TOGETHER WITH OUR AFFILIATED COMPANIES, OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AGENTS, AND LICENSORS, WILL NOT BE HELD RESPONSIBLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, OR CONSEQUENTIAL LOSSES YOU MAY EXPERIENCE IN CONNECTION WITH THE SERVICES OR ANY PRODUCT PURCHASED THROUGH THEM. THIS LIMITATION COVERS LOST PROFITS, LOST BUSINESS OPPORTUNITY, LOST DATA, THE COST OF SUBSTITUTE GOODS, AND ANY SIMILAR CATEGORY OF DAMAGE, REGARDLESS OF WHETHER THE CLAIM IS BROUGHT UNDER CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND EVEN IF WE HAVE BEEN WARNED THAT SUCH DAMAGES MIGHT OCCUR.

Section 17 — Indemnification

You agree to defend, indemnify, and hold harmless Arden Main, Ten Thirteen LLC, Shopify, and each of our respective affiliated companies, officers, employees, contractors, agents, and licensors against any third-party claim, demand, lawsuit, damage award, or expense (including reasonable attorneys' fees) that arises out of your breach of these Terms, your violation of any applicable law, or the way you have used the Services.

Section 18 — Severability

If any portion of these Terms is later determined by a court of competent jurisdiction to be invalid, illegal, or unenforceable, only that specific portion is set aside. Everything else in the document continues to operate exactly as before, and the invalid portion is treated as though it had been narrowed to the minimum extent necessary to become enforceable.

Section 19 — Entire Agreement

These Terms, taken together with our Privacy Policy and any other policy document referenced inside them, form the complete agreement between you and Arden Main regarding your use of the Services. They supersede any earlier communications, understandings, or agreements between us on the same subject matter.

Section 20 — Governing Law

These Terms are governed by and interpreted under the laws of the State of Missouri, United States, without regard to conflict-of-laws principles. Any dispute arising from or related to your use of the Services will fall under the exclusive jurisdiction of the state and federal courts located in Missouri, and by using the site you consent to that jurisdiction and venue.

Section 21 — Changes to Terms

We may revise these Terms whenever we need to. Updates take effect as soon as they are posted to this page, unless applicable law requires a longer notice period, in which case we will follow whatever schedule the law requires. Continuing to use the Services after a change has been posted means you accept the revised version.
